1. General
The website cheez-ai.com, developed and managed by Smile Events Solutions Ltd. (hereinafter: "the Website" and "the Company," respectively), provides a platform that enables event hosts, photographers, producers, individuals, and companies ("the Clients") to filter images based on the people appearing in them and distribute them to event attendees ("the Users"). Clients are required to upload images and content from events, as well as an optional guest list (names and phone numbers), and distribute a link to the Users through the Company's automated mailing system (a link will be sent via SMS or WhatsApp, subject to receiving the guest list and phone numbers). Users will be able to access the event photos via the link, after agreeing to the website's terms of use and uploading a selfie. The selfie (or its data) is not stored and will be used solely for facial recognition technology, allowing Users to view and download their personal images. The use of the system by Users is free of charge. If Clients do not provide a guest list as described above, they may also distribute images directly to Users through a system-generated link (e.g., sending the link to all employees of a company event via the company's email distribution list or via SMS/WhatsApp messaging). By using the system and services provided by the Company, each Client and User, as applicable, irrevocably confirms that they have read, understood, and agreed to these terms of use, including all aspects related to personal data, and agrees to abide by them. If these terms of use are not fully accepted, the User is requested to refrain from using the system.
2. Receiving Information
The information provided on the Website is supplied by the Clients and/or their representatives and is not verified by the Company. The Client commits that the content distributed through the system will not include any material that may harm, insult, or embarrass anyone. The Client further declares and confirms that they have the right to distribute the images, that no additional approvals are required for their distribution, that their distribution does not violate any third-party rights, and that they will indemnify the Company and its affiliates against any claims or demands related to copyright violations or unauthorized use of the content. In addition to images, Clients may provide additional event details, including but not limited to: event date, event name, Client information (full name, contact details such as phone number and email), and participant details (including full name and phone number).
3. Content Liability and Copyrights
The Client bears sole responsibility for all content provided and distributed through the system. The Company has no control over the content and does not hold any copyright over it. The Client agrees to immediately notify the Company of any claim regarding content use or copyright by sending a written notice to info@cheez-ai.com.
4. Data Storage
The information received on the Website is stored by the Company using leading external cloud service providers, such as AWS. The Company is not responsible for data storage. Image distribution is carried out via relevant service providers (such as the internet and WhatsApp application). Additionally, the Company may provide Client details to third parties involved in payment processing. Uploaded images will be stored for a limited period as determined by the Client at the time of service purchase. After this period, images will be permanently deleted with no backup or recovery option. Clients may extend the image storage period through Customer Support.
5. Use of Information
The Company does not use Users' images for any purpose other than their distribution to Users. However, information provided to the Company by Clients and/or Users may be used for internal audits, statistical analysis, research, and marketing purposes. The Company may also disclose personal information of a User and/or Client if required by law or by an authorized regulatory body.
6. Age Restriction
The use of the system is intended for Clients over the age of 18. If a Client is under 18, their use of the system constitutes confirmation and declaration that they have received parental or legal guardian consent to engage with the Company and use the system.
7. Data Modification and Deletion
Users may request the deletion of their personal data at any time by submitting a written request to info@cheez-ai.com. The Company will process deletion requests as soon as possible after verifying the request's legitimacy. This does not apply to event photos uploaded by the Client, which will be stored in the cloud until the expiration of the service period purchased by the Client. Deleting personal data may affect or limit service quality or accessibility.
8. Use of Cookies
The Company uses Cookies for the Website’s regular operation, including collecting statistical data, verifying details, and ensuring information security. Modern browsers allow users to disable Cookies. If you do not know how to do this, please check your browser's help section. By agreeing to the Website’s terms of use, you also agree to the use of Cookies. If you prefer to block Cookies during your browsing session, you can adjust your browser settings to request permission each time or deny them completely. Please refer to your browser’s help section for further instructions.
9. Cancellation, Refunds, and Credits Policy
If a Client makes a purchase and wishes to cancel within 14 days, provided no images have been uploaded to the Cheez system for an event, they will receive a full refund minus a 5% processing fee. If more than 14 days have passed, the Client is eligible for a 50% refund. Cancellation within 5 business days before the event will not entitle the Client to a refund unless the purchase was made within the previous 14 days.
Once the Client has uploaded event images, the service cannot be canceled, and no refunds or credits (partial or full) will be granted.
Clients may transfer their purchased service to a third party at no additional cost. Special cases, such as military reserve duty, will be reviewed individually.
In the event of a national emergency (e.g., war or restrictions on gatherings), the following applies:
Event postponement – The service will be provided at the rescheduled date at no extra charge.
Event cancellation – A full refund will be issued.
In any case, refund and cancellation policies are subject to Israeli Consumer Protection Law (1981), which will prevail in case of any contradictions.
